About this presumption

Bladder cancer is recognized as a presumptive condition for Vietnam-era veterans exposed to Agent Orange/tactical herbicides, added by FY21 NDAA Section 3612, effective January 5, 2021. TCDD and related dioxins are established urothelial carcinogens. This Agent Orange presumptive is distinct from the PACT Act bladder cancer presumptive (for post-9/11 veterans) — Vietnam-era veterans with bladder cancer should cite this Agent Orange presumptive. Covers all histological types of urothelial (transitional cell) carcinoma of the bladder, as well as squamous cell carcinoma and adenocarcinoma of the bladder.

Evidence still needed

A presumption does not remove the evidence requirement. VA still needs a current diagnosis from a medical provider and service records that show the qualifying service above. What it removes is the medical opinion connecting the two.

Service records confirming qualifying herbicide exposure location (Republic of Vietnam or other covered area); cystoscopy with transurethral resection of bladder tumor (TURBT); pathology confirming urothelial carcinoma or other bladder malignancy; urology and oncology records; staging information (Ta, T1, T2, T3, T4, lymph node status).
